PRIVACY POLICY

The National Privacy Principles established by the Privacy Act 1988 apply to Labour Solutions Australia Pty Ltd.

Types of Personal Information Held

Personal information that we collect and hold usually falls into but is not limited to, the following categories:

  • Candidate Information submitted and obtained from the Candidate and other sources in connection with applications for work;
  • Work performance information;
  • Information about incidents in the workplace;
  • Staff information;
  • Information submitted and obtained in relation to absences from work due to leave, illness or other causes;
  • Information obtained to assist in managing client and business relationships;

Client Information

We primarily hold personal information for the following purposes:

  • Placement operations;
  • Recruitment;
  • Staff management;
  • Training;
  • Client and business relationship management;
  • Marketing;
  • Where applicable, contractor payroll and all related operations;

Such information forms an integral part of our business, being the business of the recruitment, placement and management of personnel. There are naturally purposes which are incidental to these principal purposes.

Disclosures

We may disclose your personal information for the purposes for which it is primarily held or for a related secondary purpose. In some cases we may only disclose information with your consent, however by supplying us with your resume or otherwise requesting that we seek employment on your behalf, you will be taken to having consented to the Company using your personal and sensitive information for the above purposes and for purposes which incidental to those principal purposes.

We may disclose your personal information where we are under a legal duty to do so, including circumstances where we are under a lawful duty of care to disclose information. The Company may sell the whole or part of its business, as your sensitive information will form part of the Company records and it may be disclosed for that purpose.

What Is Your Personal Information?

Personal information is any information or an opinion (whether true or not) about you. It may range from the very sensitive (e.g. medical history or condition) to the everyday (e.g. address and phone number). It could include the opinions of others about your work performance, your work experience and qualifications, aptitude test results and other information obtained by us in connection with your possible work placements. Personal information includes sensitive information.

What Is Sensitive Information?

Sensitive information is a special category of personal information. It is information or opinion about your:

  • Political opinion;
  • Membership of a political association or religious beliefs, affiliations or philosophical beliefs;
  • Membership of a professional or trade association or membership of a trade union;
  • Sexual preferences or practices;
  • Criminal record;
  • Health or disability (at any time);
  • Expressed wishes about the future provision of health services.

It includes personal information collected to provide a health service. Sensitive information can, in most cases, only be collected with your consent. The collection of some sensitive information will be necessary to the extent that it is relevant to the requirements of a particular position.

Who Will Be Collecting And Using Your Personal And Sensitive Information?

Your personal and sensitive information will be collected by Labour Solutions Australia for its own use in the ordinary course of operating as a recruitment agency (in particular the recruitment, placement and management of personnel and all matters incidental to that activity) 

Your personal and sensitive information will naturally be provided to employers and potential employers as part of the process of finding you employment.  By requesting that we seek employment on your behalf and by otherwise providing information to us, you will be

taken as having consented to Labour Solutions Australia using such information for the uses set out above and for the other specific uses set out below.

If the whole or part of the business/franchises of Labour Solutions Australia are sold, you authorise any such purchaser to use your personal and sensitive information for the purpose of the business of recruitment, placement and management of personnel and for uses which are incidental to that purpose.

How Your Information Will Be Collected

Personal and sensitive information will be collected from you directly when you fill out and submit one of our registration forms or any other information in connection with your application to us for registration. Collection may be done electronically via the web or e-mail, by mail, in person, by fax or over the phone.

Personal and sensitive information will also be collected when:

  • We receive any reference about you;
  • We receive results of inquiries that we might make of your former employers, work colleagues, professional
  • associations or registration body;
  • We receive the results of any competency, technical skills or medical tests;
  • We receive the results of any psychological assessments;
  • We receive verification of academic achievements;
  • We receive any performance feedback;
  • We receive any complaint from or about you in the workplace;
  • We receive any information about a workplace accident in which you are involved;
  • We receive any information about any insurance investigation, litigation, registration or professional
  • disciplinary matter, criminal matter, inquest or inquiry in which you are involved;
  • You provide us with any additional information about you.
  • We receive requests for information or instructions from government departments or agencies or other private bodies that have appropriate authority to make such requests or give such instructions.
  • We receive the results of police checks, where such checks are required.

How Your Information Will Be Used

Your personal and sensitive information may be used in connection with:

  • Your actual or possible work placement, including reverse marketing;
  • Matters relating to immigration and your visa status, if applicable;
  • Internally generated and used recruitment market intelligence;
  • Your performance appraisals;
  • Our assessment of your ongoing performance and prospects;
  • Any test or assessment (including medical tests and assessments) that you might be required to undergo;
  • Our identification of your training needs;
  • Any workplace rehabilitation;
  • Our management of any complaint, investigation or inquiry in which you are involved;
  • Any insurance claim or proposal that requires disclosure of your personal or sensitive information.
  • And where applicable; your wage payment and all related functions and client billing.
  • All or any purpose for which such information would ordinarily be used by or as part of the business of a recruitment agency.

Your Personal And Sensitive Information May Be Disclosed To:

  • Potential and actual employers and clients of Labour Solutions Australia
  • Referees;
  • Other members of Labour Solutions Australia;
  • Our insurers and relevant Superannuation companies;
  • A professional association or registration body that has a proper interest in the disclosure of your personal and sensitive information;
  • A Workers Compensation body;
  • Our contractors and suppliers - e.g. Our I.T. contractors and database designers;
  • Any person with a lawful entitlement to obtain the information, including courts, government departments, and agencies;

If You Do Not Give Us The Information We Seek:

  • We may be limited in our ability to locate suitable work for you;
  • We may be limited in our ability to place you in work.

Your Rights As A Candidate

As a candidate, you can expect to enjoy the following rights:

  • The employment placement service must not charge a job seeker a fee for the purpose of finding the job seeker employment;
  • An employment placement service must not engage in misleading or deceptive conduct (such as advertising a position as being available when the agency knows no such position exists or knowingly giving misleading information to a job seeker about the nature of a position);
  • If a job seeker believes that an employment placement service has acted inappropriately, the job seeker may contact the Department of Fair Trading for information on possible action that may be taken;

Understanding and Agreement

You consent to the collection, use and storage of your personal and sensitive information by submitting it to Labour Solutions Australia in any written or oral form, or by any other means whatsoever. Your consent then covers all forms of future communication. In submitting your personal and sensitive information, you undertake to have read and understood each of the statements in this Collection Statement and voluntarily consent to:

  • Personal and sensitive information about me being collected by you as indicated above;
  • Personal and sensitive information about me being used as indicated above;
  • Personal and sensitive information about me being disclosed as indicated above.
